These Terms of Use (the "Terms") are a legal agreement between you and Guilder Funding LLC ("Guilder Funding," "we," "us," or "our") that governs your access to and use of the Guilder Funding website, free business-financing intake quizzes, business-financing and related calculators, email communications, and any other services we provide (collectively, the "Services").
By accessing or using the Services, you agree to these Terms. If you do not agree, do not use the Services.
These Terms include a binding arbitration agreement and class-action waiver in Section 14. Please read them carefully.
1. Eligibility
The Services are intended for residents of the United States who are at least 18 years old. By using the Services, you represent that (a) you are 18 or older, (b) you reside in the United States, and (c) you have the legal capacity to enter into these Terms. We do not knowingly accept information from anyone under 18.
2. The Services are informational only, not financial advice
Guilder Funding publishes editorial and educational content about personal-finance topics, primarily business financing, debt consolidation, balance-transfer credit cards, high-yield savings, and related products. We provide free interactive tools (quizzes and calculators) to help you understand your options.
We are not a financial advisor, credit counselor, attorney, accountant, tax preparer, business financing provider, lender, bank, credit-card issuer, insurance company, or registered broker-dealer. Nothing on the Services constitutes individualized financial, tax, legal, accounting, or investment advice. The content reflects our editorial views and our partners' published information, which may change without notice.
Before making any decision about business financing, including applying with a funding partner or enrolling in a credit-repair program, consult a qualified professional in your state.
3. We do not provide financial products
Guilder Funding does not offer loans, lines of credit, merchant cash advances, SBA financing, equipment financing, or any other financial product. We do not approve applications, make credit decisions, set interest rates or fees, or negotiate terms on your behalf.
Any actual financial product or service is offered by, and any application is processed by, the third-party funding partner we match you with after you submit our intake form. Approval, rates, terms, fees, and final product details are determined entirely by that partner, subject to their underwriting and your eligibility under their state-specific licensing.
4. Intake form and matching
Our intake form asks you for information about your business and funding need (e.g., monthly revenue, time in business, credit profile range, financing amount, and use of funds) and uses that information to route your submission to one funding partner whose acceptance criteria best fit your profile. We do not blast your information across a network.
The match does not constitute an offer, pre-approval, or qualification for any financial product. Whether you actually qualify is determined by the partner's underwriting process when their representative contacts you and you choose to apply with them.

5. Affiliate relationships
Guilder Funding is an advertising-supported service. We earn compensation when you click an affiliate link on our site and complete a qualifying action with our partner (such as taking a phone call, completing an application, or enrolling in a program). This compensation may impact which offers we feature and the order in which they appear, though it does not influence our editorial rankings or our written reviews of products.

6. Accuracy of information
We make a good-faith effort to keep rates, fees, terms, and program details current. However, our partners update their offers frequently, and we cannot guarantee that every detail on the site reflects the most current information at the moment you read it. Always confirm rates, fees, eligibility requirements, and program terms directly with the partner before applying or enrolling.
Information about partner programs is sourced from each partner's published materials and disclosures. We disclaim liability for inaccuracies arising from changes to third-party offerings that we have not yet incorporated.
7. Permitted use and prohibitions
You agree to use the Services only for lawful purposes and in accordance with these Terms. You will not:
- Scrape, crawl, or use automated tools to access or copy the Services beyond standard search-engine indexing
- Submit false, fraudulent, or incomplete information to our quizzes or forms
- Use the Services to harass, defame, or impersonate any person
- Interfere with or disrupt the Services or the servers and networks that host them
- Attempt to gain unauthorized access to any portion of the Services, related systems, or user data
- Reverse engineer, decompile, or attempt to derive source code from the Services
- Use the Services to send unsolicited commercial communications (spam)
- Use the Services in a way that violates any applicable law, regulation, or third-party right
8. Intellectual property
All content on the Services, including text, graphics, logos, layouts, images, calculators, quiz mechanics, and software, is owned by Guilder Funding or our licensors and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services for personal, non-commercial purposes. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any portion of the Services without our prior written consent.
9. Third-party links and partners
The Services contain links to websites operated by our affiliate partners and other third parties. We do not control those websites, and we are not responsible for their content, products, services, privacy practices, or interactions with you. Your use of any third-party site is at your own risk and is subject to that site's terms and privacy policy, not ours.
When you complete an application or enrollment with a partner, you are entering into an agreement directly with that partner. Any disputes, problems, or claims arising from that relationship are between you and the partner.
10. Privacy
Your privacy is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you acknowledge that you have read and agree to the Privacy Policy.
11. Disclaimer of warranties
The Services are provided "as is" and "as available," without warranty of any kind, whether express, implied, or statutory. To the maximum extent permitted by law, Guilder Funding disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, reliability, and uninterrupted availability. We do not warrant that the Services will be error-free, that defects will be corrected, or that the Services or the servers that host them are free of viruses or harmful components.
12. Limitation of liability
To the maximum extent permitted by applicable law, Guilder Funding and our officers, directors, employees, contractors, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, business opportunity, or savings, arising from or related to your use of the Services, even if we have been advised of the possibility of such damages. Our aggregate liability to you for any claim arising from or related to the Services will not exceed the greater of (a) the total fees you paid Guilder Funding in the twelve months before the claim arose (which is zero, because the Services are free) or (b) one hundred U.S. dollars ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Guilder Funding and our officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or related to (a) your use or misuse of the Services, (b) your breach of these Terms, (c) your violation of any law or regulation, or (d) your violation of any third-party right.
14. Binding arbitration and class-action waiver
Please read this section carefully, it limits how you can resolve disputes with Guilder Funding.
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services (each, a "Dispute") will be resolved exclusively by binding arbitration administered by JAMS in accordance with its Streamlined Arbitration Rules and Procedures. The arbitration will take place in the county and state designated under Section 15 (Governing Law), or by telephone/video conference at the parties' agreement. Judgment on the award may be entered in any court of competent jurisdiction.
You and Guilder Funding each waive any right to bring or participate in any class action, collective action, or representative proceeding in connection with a Dispute. The arbitrator may not consolidate more than one person's claims and may not preside over any form of representative or class proceeding.
Notwithstanding the above, either party may bring a claim in small-claims court if the Dispute is within that court's jurisdiction, and either party may seek temporary injunctive relief from a court of competent jurisdiction to protect its intellectual property pending arbitration.
30-day opt-out: you can opt out of this arbitration agreement and class-action waiver within 30 days of first accepting these Terms by emailing legal@guilderfunding.com with the subject line "Arbitration Opt-Out" and your full name and email address used on the Services.
15. Governing law and venue
These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-law principles. Subject to Section 14, any dispute that is not subject to arbitration will be resolved exclusively in the state or federal courts located in Mecklenburg County, North Carolina, and you consent to personal jurisdiction in those courts.
16. Termination
We may suspend or terminate your access to the Services at any time, for any reason, with or without notice. You may stop using the Services at any time. Sections that by their nature should survive termination (including Sections 8, 11, 12, 13, 14, 15, and 17) will survive.
17. Modifications to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page. Material changes will be communicated by email to subscribers and/or a banner on the site at least 14 days before they take effect. Continuing to use the Services after the effective date constitutes acceptance of the updated Terms.
18. Miscellaneous
- Entire agreement. These Terms, together with the Privacy Policy and our other policies referenced herein, constitute the entire agreement between you and Guilder Funding regarding the Services.
- Severability. If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force and effect.
- No waiver. Our failure to enforce any provision is not a waiver of that provision.
- Assignment. You may not assign these Terms without our consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
- Force majeure. Neither party is liable for failures caused by events beyond reasonable control.
- Notices. We may give notice by posting on the Services or by emailing the address you provided.
- Headings. Section headings are for convenience only and do not affect interpretation.
